“An American President is not a king,” one Washington, DC-based US district court judge wrote in an early challenge to Trump. Friday’s ruling, combined with a decision last year that gave the president substantial immunity from prosecution, amplifies the power of the American presidency more than ever.
“The other shoe has dropped on executive immunity,” Justice Sonia Sotomayor.
The dissenting justice condemn the majority for a decision that “kneecaps the judiciary’s authority” to stop the president from acting unconstitutionally.
Several lower court judges blocked enforcement of the order, on preliminary findings that it was unconstitutional, and the Trump administration appealed to the Supreme Court. The administration did not seek a decision on the constitutionality of the order proposing to deny passports and other documents to children born to people without citizenship.
Rather, it wanted the high court to declare that US district court judges lacked the power to issue sweeping “universal injunctions” against Trump policies as they were litigated. Such injunctions have been invoked to block a challenged policy not just as it would be applied to the parties in a case but to prohibit its enforcement throughout the country. CNN
THE UNHOLY COUP: We knew the Supreme Court was corrupt when newly confirmed justices lied to Congress in order to get the job. As soon as Roberts had his majority, they went after abortion rights. Then the whole Ginni Thomas J6 bullshit came to light, which exposed the depth of treasonous corruption. The Supreme Court then went even further. They refused to deal with Jack Smith, the classified documents and J6 prosecutor, and then at the very last moment, ruled that presidents were immune.
They bought Trump just enough time to avoid prosecution on multiple insanely serious charges. Guess what happened next, yip, the fucker became president. Now they’ve gone even further by basically giving him free reign to bulldoze his way over the government, Constitution, and everything Americans hold sacred. Make no mistake, this ruling is really bad news.
MAGA has been criticising Amy Coney Barrett for being a DEI hire and blocking Trump’s agenda. Trump himself went after Leonard Leo and the Federalist Society not so long ago. The threats worked a charm. Amy just helped MAGA screw America. The only power to stop any unconstitutional executive orders now rests solely with the Supreme Bought. And they are bought, so basically the judicial coup is complete.
Trump owns the House, Senate, and Supreme Court. He even owns the Pentagon, FBI, CIA, Attorney General, Homeland Security and Justice Department. Surely I don’t have to point out how problematic this scenario is. If he now manages to pass the stupid bill, it will legalize the coup, the final step. If We the People decide to resist, Trump will invoke the Insurrection Act and declare Martial Law. Think about it, the Supreme Court has given him the authority to deport people to countries that are not their home countries. That should chill you to the bone.
Unfortunately Trump feels like the king of the world at the moment. He just bombed Iran, ‘saved’ Israel, got NATO to increase their defense spending, and is anticipating the bill to pass. He is high on his own power right now, invincible, infallible, and dare I say it, most probably impotent.
It’s all a load of bullshit, all of it. This is a lesson in tolerating intolerance. Fascists just need a small opening in society, someone like Trump that embraces their intolerant hateful manner. Christian fundamentalists are equally as hateful and that’s why these groups found common ground in their savior Trump, he represents the very worst of American culture. Just the way they like it.
Please remember that they are a minority, not the majority. This is what happened in South Africa, a tiny minority ruled a huge majority for 46 years during Apartheid, that’s almost half a century. Now ask yourself if you are willing for your children and grandchildren to grow up in this type of world? If the answer is no, then I highly recommend you do something about it. You have to be the change, don’t wait for someone else to save you, by then it might be too late.
DISASTER LOOMS: Jackson had issued ominous warnings in her own blistering dissent. ‘Disaster looms,’ she said.
‘What I mean by this is that our rights-based legal system can only function properly if the Executive, and everyone else, is always bound by law.
‘Today’s decision is a seismic shock to that foundational norm. Allowing the Executive to violate the law at its prerogative with respect to anyone who has not yet sued carves out a huge exception—a gash in the basic tenets of our founding charter that could turn out to be a mortal wound,’ she wrote.
‘What is more, to me, requiring courts themselves to provide the dagger (by giving their imprimatur to the Executive Branch’s intermittent lawlessness) makes a mockery of the Judiciary’s solemn duty to safeguard the rule of law,’ she added.
Jackson, cited a ruling about the ‘accretion of dangerous power, and wrote that the Court has ‘cleared a path for the Executive to choose law-free action at this perilous moment for our Constitution—right when the Judiciary should be hunkering down to do all it can to preserve the law’s constraints.’
She warned of a ‘rule-of-kings governing system’ compared to a ‘rule of law regime.’
‘At the very least, I lament that the majority is so caught up in minutiae of the Government’s self-serving, finger-pointing arguments that it misses the plot.’ Justice Ketanji Brown Jackson.
